Terms of Use
These Terms of Use (“Terms”) govern your use of the Weather Then mobile application and related services (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
The service
Weather Then helps you compare current and forecast weather with historical observations and climate summaries for places you choose. Features may change as we improve the App.
The App is offered for the United States. Historical observations and climate comparisons use U.S. NOAA GHCN stations. Current conditions and forecasts may still appear for places outside the United States, but historical Then, Trends, and Climate data for those places will be unavailable.
The App is provided for general informational and educational purposes. It is not an official government weather service, and it is not a substitute for National Weather Service products, watches, warnings, or emergency instructions.
Eligibility
The App is intended for distribution in the United States app stores. You must be at least 13 years old (or the age required by the app store you use) and able to form a binding contract. If you use the App on behalf of an organization, you represent that you have authority to accept these Terms for that organization.
Location and permissions
Some features need your location or a place you enter. You can control location permission in your device settings. Without a place, certain features may not work.
Acceptable use
You agree not to misuse the App or our APIs — including attempting to scrape or bulk-download data beyond normal interactive use, interfere with service operation, bypass rate limits or security measures, or use the App in violation of law.
We may suspend or limit access if we detect abuse or risk to the service or other users.
Data sources and attribution
Forecast information is provided via Open-Meteo and underlying meteorological model data. Historical daily observations are based on NOAA’s Global Historical Climatology Network–Daily (GHCN-Daily). Those providers’ terms, licences, and disclaimers also apply to their data. Credits and methodology notes appear in the App’s About section.
Intellectual property
The App’s design, branding, and original content are owned by us or our licensors. Weather and climate data remain subject to their respective source licences. You may use the App for personal, non-commercial viewing unless we expressly allow otherwise (for example through a paid commercial offering). You may not copy, reverse engineer, or redistribute the App except as allowed by law or app-store rules.
Purchases
If the App offers paid features or subscriptions, billing is handled by Apple or Google under their terms. Refunds are subject to the applicable store’s policies unless we state otherwise.
Disclaimer of warranties
THE APP AND ALL WEATHER, CLIMATE, AND RELATED INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Weather observations and forecasts can be incomplete, delayed, or wrong. Station locations may be miles from your address. Do not rely on the App as your only source for safety-critical decisions.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY INFORMATION IN IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) TEN U.S. DOLLARS (US$10).
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
Privacy
Our Privacy Policy describes how we handle information. By using the App, you also acknowledge that policy.
Changes and termination
We may update these Terms by posting a revised version in the App (and on our website when available). The effective date will change when we do. Continued use after an update constitutes acceptance. We may discontinue or change the App at any time. You may stop using the App at any time by uninstalling it.
Governing law
These Terms are governed by the laws of the United States and the State of Washington, excluding conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Courts in King County, Washington, will have jurisdiction over disputes that are not subject to a mandatory venue elsewhere — again subject to non-waivable consumer rights where you live.
